European plant breeders' rights

Besides national plant breeders’ rights, there is also community (European) plant breeders’ rights. Community plant breeders’ rights are valid on the whole territory of the EU member states.

European plant breeders' rights

Community plant breeders’ rights is not European authorisation. If you want to trade the variety within the EU in addition to protection, you also need permission in at least one of the member states of the European Union. The requirement of (compulsory) admission applies to varieties of vegetable, agricultural and fruit crops.

The CPVO (Community Plant Variety Office at Angers in France) grants community plant breeders’ rights. You can apply for community plant breeders’ rights via the CPVO's-website. You can also find the fees here.

Take over DUS report

Does the variety already has national plant breeders’ rights or authorisation? Then the DUS-report can often be taken over by the CPVO. This eliminates the need for a new DUS-test. If you wish to take over the report, please indicate this on the application form.

Validity of community plant breeders' rights

Community plant breeders’ rights are granted for 25 years. Varieties of crops of asparagus, potatoes, vines, flower bulbs and trees, among others, community plant breeders’ rights are granted for 30 years.
